Your rights under the settlement

Options to participate

The Settlement Approval Hearing took place on March 30-31, 2026. The judge is now reviewing each settlement, and the requests for lawyers fees and honoraria payments for the Representative Plaintiffs and Steering Committee members, and will determine whether they are fair and in the best interests of class members.

You have options for how you want to participate in the settlement.

Wait

If you agree with the proposed  settlements, you do not have to do anything right now.

If the Court approves the proposed settlements, information will be made available about when and how to make a claim for compensation

Object

Class members had the opportunity to object to the proposed settlements prior to the hearing so their concerns could be raised to the judge. Objections were received up to March 29, 2026.

If the proposed settlements are not approved by the Court, then class members will not be able to receive compensation.

Opt out

Opting out means that you will not receive compensation under the Île-à-la-Crosse School Settlement if it is approved by the Court. However, if you opt out, you will maintain your right to bring your own lawsuit for harms experienced while attending Île-à-la-Crosse School.

If you wish to opt out, and do not want to receive compensation under the Île-à-la-Crosse School Settlement, you need to submit an Opt Out Form to the Administrator no later than 90 days after the proposed settlements have been approved by the Court. This deadline will be provided as soon as it is available.

What is the difference between objecting and opting out of the settlements?

Objecting to the Île-à-la-Crosse School Settlement and opting out are not the same thing.

Object

If you object to the settlement, but it is approved by the Court, you can still make a claim for compensation if you are eligible.

Opt-Out

If you opt out of the settlement, you are telling the Court that you do not want to receive compensation under the settlement, even if it is approved.

If you have any questions about objecting to or opting out of the settlement, contact the Administrator at info@ILEXSettlement.ca or call toll free at 1-833-700-7458.
