Representatives
Who can submit an application as a representative?
You may be able to apply if you are:
- A Personal Representative for a Survivor who cannot act on their own behalf
- An Estate Representative for a Survivor who passed away on or after December 9, 2003
- An Eligible Heir of a Survivor who passed away on or after December 9, 2003, and did not leave a will or appointed estate representative. If there is more than one eligible heir, the other equal-priority heirs can choose a Designated Heir to apply on behalf of the family
→ Applications for Experience Payment claims can be submitted until June 1, 2027.
→ Applications for Abuse Compensation claims can be submitted until June 1, 2028.
Which claim form should representatives use?
If you are submitting a claim for someone else, use the Claim Form for Representatives of Survivor Class Members.
The form includes sections for:
- Personal Representatives for a Person Under Disability
- Estate Representatives
- Eligible Heirs
- Designated Heirs
Every representative must fill out Parts 1-3 of the form. Parts 4-8 of the form depend on your role as a representative, the Survivor, and the Survivor’s experience at the school.
You can complete the form online through the claims portal (when ready) or submit a paper copy by mail, fax, or email.
Personal Representatives for a Person Under Disability
A Personal Representative may submit a claim form on behalf of a Person Under Disability.
For this settlement, a Person Under Disability is a Survivor who is mentally incapable of managing their finances and has a legally appointed representative acting on their behalf.
You will need to provide:
- Documentation showing your legal authority to act for the Survivor
- Copies of valid government-issued identification
- Information about the Survivor’s attendance at the Île-à-la-Crosse School
- Examples of accepted representation documents include:
- An appointment order under adult guardianship legislation
- An enduring power of attorney signed before the Survivor became incapable
- Appointment of a Public Guardian or Trustee
- Other legal documentation showing authority to act
You will also complete Parts 1-3 of the representative claim form, including information about school attendance and payment preferences.
Estate Representatives
An Estate Representative may submit a claim form for a Survivor who passed away on or after December 9, 2003.
An Estate Representative is someone who has legal authority to act for the deceased Survivor’s estate, such as:
- An executor named in a will
- An administrator appointed by the court
- A trustee or liquidator of the estate
You will need to provide:
- The Survivor’s death certificate or other proof of death
- A copy of the will naming you as executor or liquidator
- Probate documents or letters of administration, if applicable
- Valid government-issued identification
If there is a valid will or court appointment, applications for compensation would be submitted through the Estate Representative and not through an heir.
Eligible Heirs
An eligible heir may submit a claim form if:
- The Survivor passed away on or after December 9, 2003
- The Survivor did not leave a valid will
- No Estate Representative has been appointed
Eligible heirs may include:
- Married spouses
- Common-law spouses
- Children
- Siblings
- Adult grandchildren (Experience Payment claims only)
The claim form includes a priority order that determines who may apply first. You may need to provide:
- The Survivor’s death certificate or proof of death
- Documents showing your relationship to the Survivor
- A solemn declaration if formal documents are not available
Examples of supporting documents may include:
Birth certificates
Marriage certificates
Adoption records
Obituaries
Court orders
Sworn declarations
If documents are unavailable, you may still apply using solemn declarations included in the claim form (Part 8).
Designated Heirs
Sometimes there may be more than one living heir with equal priority, such as multiple children or siblings.
In these situations, the heirs may choose one person to act as the Designated Heir Claimant.
The Designated Heir submits the claim on behalf of the equal-priority heirs.
If you are the Designated Heir, you will need to:
- Complete the Designated Heir declaration (Part 7)
- List the names and contact information of the other equal-priority heirs
- Include signatures from the other heirs confirming they agree with the designation
The Designated Heir is responsible for distributing any compensation equally among the equal-priority heirs.
Before you submit your claim form
Please ensure that you include:
- Copies of identification
- Copies of documents supporting school attendance
- Copies of legal or family relationship documents, if applicable
- Banking information if requesting direct deposit
If you do not have every document right away, you can still begin the process.
After you submit your claim form
The Administrator will review the application and may contact you if more information is needed.
You will receive updates using the contact method you selected on the form.
